Investor Visas

Employment Creation Investor's Visa

Entrepreneurs who plan to invest a substantial amount of capital to create a new business or purchase and expand an U.S. existing business in U.S. may be eligible to obtain an investor's visa and immigrate to the United States.

Ten thousand foreign investors' visas are available through the U.S. Citizenship and Immigration Services (USCIS) each year. Half of those visas are reserved for investors who locate their businesses in regions designated as in need of economic development.

Foreign investors strengthen the U.S. economy by creating jobs for U.S. workers.

To be eligible for immigration through investment, the investor must:

  • Create an original business, or
  • Purchase an existing business and restructure it into a new commercial enterprise, or
  • Expand an existing business by 140 percent of the pre-investment number of jobs or net worth, or retaining all existing jobs in a troubled business.
  • Invest at least $1,000,000, or invest at least $500,000 in a business located in a targeted employment area.
  • Create 10 full-time jobs, or
  • Invest in a troubled business and maintain the existing number of jobs for at least two years

Our immigration lawyers can help you seek status as an immigrant investor whether you currently live abroad or in the U.S. We will file an Immigrant Petition by Alien Entrepreneur form. In addition to meeting the requirements above, we will prepare documentation to prove your investment comes from a lawful source of funds and show you are actively participating in the business.

If you are considering creating or purchasing a business in the United States, please contact the immigration attorneys at Byrd & Associates. We will explore all of your options, including EB-5 investor visas, treaty investor visas, treaty trader visas, and filing an immigrant petition by an alien entrepreneur.
